THE OUTRAGEOUS AND ILLEGAL RAILROADING OF FORMER CONGRESSMAN GEORGE HANSEN – PART ONE

In the Orwellian year of 1984 Congressman George Hansen (R-ID), warned that judicial terrorism was stalking America. That was the year he was railroaded to prison. It took ten long years for the U.S. Supreme Court to finally overturn a flagrantly rogue conviction.

The George Hansen odyssey begins just before noon on June 5, 1976 in southeastern Idaho when the massive, earthen Teton Dam burst. Built by the U.S. Bureau of Reclamation it ruptured immediately after being filled with 80 billion gallons of water resulting in a surge of raging flood waters that obliterated 16,000 head of cattle; decimated thousands of acres of prime farmland and destroyed a slew of cities and towns. The roiling flood waters also destroyed seven bridges; according to the Idaho Transportation Department nearly 80 percent of the valley’s 700 miles of county roads were washed away. Railways were also demolished. Swift action among the citizens limited the fatalities to just eleven. https://en.wikipedia.org/wiki/Teton_Dam

Hansen swung into action and quickly secured $400 Million in flood damage reimbursements to the stricken farmers. Shortly afterward the Law of Unintended Consequences struck without warning. Just when people were laboring to put their lives back together the other side of government showed up: the IRS swooped down on the hapless flood victims with extravagant schemes to tax their relief payments!!

In a sworn affidavit to the Barnard Commission senior Treasury Agent Paul DesFosses stated:

IRS management boasted they would ‘recover’ much of the reimbursement through capital gains taxes, investment credit recapture and other taxes.

Example: If farmers replanted with wheat, or alfalfa, instead of potatoes – because it was too late in the season to re-plant potatoes – they were required to pay a capital gains tax on the new farm equipment they received!! To justify the capital gains taxes conniving revenue agents invoked a broad and ambiguous tax code provision involving “replacement of like kind.”

Congressman Hansen would have none of it bitterly denouncing IRS’ schemes as a “Flood Tax.” Farmers and ranchers got to pay for the “privilege” of having a lifetime of dreams and hard work wiped out by a faulty government dam.

Events took a turn for the worse three weeks before Election Day 1976 when a long article appeared in the Lewiston newspaper, Lewiston Morning Tribune. With what appeared to be lots of corroborating evidence, the article alleged that Congressman Hansen was not paying his taxes.

Who was behind it?

In a sworn affidavit former Treasury Agent Paul DesFosses provides this input:

“Following the successful completion of the IRS project to politically destroy Senator Joseph Montoya, William B. Orr was promoted to the position of Assistant Director in the Denver IRS District and C. Evan Wride was promoted to the position of Chief of the Criminal Investigation Division in the Salt Lake City IRS District Office.”

According to DesFosses, after being transferred from Albuquerque to Salt Lake City, IRS Intelligence Chief Evan Wride quickly became embroiled in sabotaging Congressman George Hansen.

Information gathered from confidential IRS memos and testimony provided to the Barnard Committee by DesFosses reveal how these desperadoes plotted to sabotage the 1976 reelection of U.S. Representative George Hansen. Stan Kress was his Democrat opponent.

  • IRS Intelligence Chief Evan Wride leaked selective information to Robert Huntley, Kress’ Campaign Treasurer, who in turn provided it to Stan Kress so that he could use it against Congressman Hansen in a debate held at Idaho State University.

  • Huntley also contacted people with the Lewiston newspaper.

  • A clandestine meeting was held in the office of Professor Richard Stallings at Rick’s College. Stallings was the campaign manager for Stan Kress who also attended the meeting along with IRS District Director Howard Martin. The meeting was moved to the Stardust Motel where Martin was staying since Professor Stallings could not lock his office door and feared that the scheme would be compromised.

  • Another participant identified by DesFosses was the former IRS District Director Cal Wright who, according to DesFosses, met with a Lewiston Morning Tribune reporter in a Boise parking lot in the middle of the night to deliver Hansen’s tax records that allegedly corroborated serious filing deficiencies.

Throughout the controversy Congressman Hansen insisted that he had paid his taxes and that the newspaper accounts were not true. Despite IRS’ treachery Hansen won reelection.

Afterwards DesFosses reported the illegal planning and sabotaging of Hansen’s reelection he claimed that he was quickly stymied by the US Attorney’s office.

“During the summer of 1977 your Affiant had an opportunity to meet with then U.S. Attorney for Idaho, Karl Shurtliff, and I informed him of these events. Karl Shurtliff indicated to me that he was well aware of the matter and had gone over all of it with IRS [District] Director Howard Martin. Karl Shurtliff indicated to me that it was agreed that he, as U.S. District Attorney, would just sit on everything until the statute of limitations ran out. …

“Karl Shurtliff, being a personal friend and long acquaintance advised me to keep my mouth shut.

To everyone’s surprise Hansen beat the IRS at their own game. But the IRS wasn’t ready to give up. Instead of investigating the criminal IRS agents who illegally planted false stories in the press the IRS continued to hound and harass Congressman Hansen by putting him through the wringer with a two-year long criminal audit!

Unique And Selective Prosecution

Here is a DEEP STATE blueprint for railroading an innocent person to prison:

• After the 1976 collapse of the Teton Dam Congressman Hansen trounced the IRS for taxing relief monies disbursed to flood victims labeling IRS’s contrived schemes a “Flood Tax.”

• The IRS retaliates by sabotaging George Hansen’s congressional race by planting false stories in the press just three weeks before election, the same gutter-ball strategy that was earlier used to destroy Senator Ed Long and Senator Joseph Montoya.

• When Congressman Hansen won the election – despite IRS treachery – he had to endure a brutal two year criminal audit. Result? The audit determined that Hansen was owed a refund.

The victories however came at a heavy cost. Years of attack by the government depleted the Hansen family’s modest resources and pushed them under a mountain of crushing debt.

• Acting under the advice of three attorneys, Hansen executed a Property Separation Agreement with his wife, Connie. This was done in response to a determination by the House Administration Committee that Hansen could not use his congressional office to raise money to pay legal debts even though the massive debts were the direct result of defending himself from an unremitting campaign of ruthless attacks. In accordance with the Property Separation Agreement Connie Hansen “inherited” the debts and was striving to pay them while George continued his work as a congressman.

• The Ethics In Government Act (EIGA) – enacted in 1979 – required Representatives and Senators to file financial disclosure forms that included their spouse’s finances. This provision however violated the Property Separation Agreement that Congressman Hansen was abiding by prior to the passage of EIGA. Consequently a mutual understanding was reached with the House Ethics Committee that Congressman Hansen would not include his wife’s finances due to his unique legal circumstance that existed prior to EIGA passage. In fact Rep. Charles Wiggins, then a ranking member of the Ethics Committee, certified in a formal deposition that Hansen’s non-disclosure was approved by the Committee.

Why George Hansen Should Be Pardoned. Human Events Sept 13, 1986

• In April 1981 Texas oil billionaire Nelson Bunker Hunt, who provided assistance to Connie, received a blackmail letter accusing him of paying for favors performed by Congressman Hansen. This was used as a pretext to “investigate” the Idaho congressman. Two attorneys from the DOJ “Public Integrity Section” are assigned: Reid Weingarten and James Cole.

• After “investigating” Congressman Hansen for almost two years, Weingarten and Cole admitted that no quid pro quo existed: Congressman Hansen did not perform any favors for oil tycoon Bunker Hunt and in fact barely knew him. But the DEEP STATE predators didn’t stop there. The headhunters then contrived to frame a criminal case against Congressman Hansen for omitting his wife’s finances on his financial disclosure documents. They did this by resolutely ignoring how the Ethics Committee accommodated Hansen’s financial filings due to his unique legal circumstance that existed prior to the passage of EIGA. They also ignored that Congress legislated that civil sanctions were to be imposed when financial disclosure requirements were not obligated.

Sen. Orrin Hatch: George Hansen and Congressional Intent Feb. 85’ Congressional Majority Committee Vol. 5 No.1

  • Weingarten and Cole contrived a criminal case against Hansen by invoking a catch-all provision in criminal law, 18 USC 1001, that makes it illegal to submit a false document to the government. In order to appreciate just how odious the legal lynching of Congressman Hansen was it is instructive to consider other high-profile cases from that era.

• In 1984 Ed Meese was appointed as Attorney General by President Ronald Reagan. During his confirmation hearings it was revealed that he had not included his wife’s finances on his financial disclosure filings. According to the New York Times “Mr. Meese apologized for having ‘inadvertently failed to list’ the loan [made to his wife] and said he was in the process of amending his financial disclosure report.”

http://www.nytimes.com/1984/03/14/us/meese-discloses-loan-that-friend-made-to-his-wife-byrd-speaks-to-baker.html

•In 1984 Rep. Geraldine Ferraro was chosen by presidential candidate Walter Mondale to be his running mate. Afterward it was soon revealed that Ferraro had not included her husband’s finances on her disclosure filings. Her proffered reason was that she did not understand the law. In fact her husband had many shady business dealings. Example: “Among his warehouse tenants, a block from his office, was Star Distributors, which law enforcement officials called a major distributor of pornography linked to organized crime.” After it was discovered that Ferraro omitted her husband’s shady business dealings she was permitted to amend her financial disclosure filings without consequence.

Congressman Hansen’s staff attorney, James McKenna, researched the matter further and discovered that nearly one fourth of House of Representative members failed to disclose their spouse’s finances on their disclosure statements. Across the board they were allowed to quietly amend their disclosure statements without consequence.

Yet Congressman Hansen – the one who worked directly with the Ethics Committee to reconcile his filings commensurate with his unique legal situation – was prosecuted by the head hunters at the Justice Department.

Congressman Hansen’s staff attorney, James McKenna, explained in a letter to Deputy Attorney General D. Lowell Jensen:

This is not selective prosecution. This is exclusive and unique prosecution.

The proof of Congressman Hansen’s innocence was contained in the back and forth correspondence he had with the Ethics Committee. Yet U.S. District Judge Joyce Green, struck down his request for Ethics Committee files and testimony by House officials leaving him with no legal defense. Consequently Hansen was found guilty on three of the four charges and sentenced to 15 months in prison. Judge Green also imposed a whopping $40,000 fine.

After many years of fighting government injustices Congressman Hansen got the boot and was carted off to federal prison. His crime? He committed no crime. The government had to invent one to ensnare him. Justice attorneys Weingarten and Cole mutated a technical contrivance into a felony all the while ignoring that genuine violations of EIGA were committed by Attorney General Ed Meese, vice-presidential Geraldine Ferraro and scores of other members of Congress.

• Scores of other members of Congress are allowed to quietly amend their EIGA disclosures

• Ed Meese, the one who forgot to include his wife’s finances is elevated to Attorney General.

• Geraldine Ferraro, who omitted her husband’s finances to ostensibly to conceal his shady businesses, becomes the Democrat 1984 candidate for Vice President. In fact the Ethics Committee churned out excuses for not prosecuting Ferraro asserting that law is “clouded with some amount of ambiguity,” and how the practice of other members “has encouraged confusion as to the exemptions meaning.” Accordingly the Ethics Committee even refused to reprimand Ferraro for the violation.

• Congressman George Hansen, who worked out a mutual understanding with the Ethics Committee because of a binding Property Separation Agreement that was executed prior to the passage of EIGA, is railroaded to prison.

Eleven years later, in 1995, the Supreme Court reversed Hansen’s conviction. This happened long after he had served his prison time. The 1995 ruling also demanded that the government refund the $40,000 fine that Judge Joyce Green imposed. By then the Hansen family had already lost their home – it was sold in 1984 in order to pay the $40,000 fine.

The notion that how we are governed is determined by the will of “we the people” has been under siege for a very long time. Over 50 years ago DEEP STATE operatives in the IRS and the FBI plotted to remove powerful leaders of Congress who were alarmed by what was happening to America.

When the IRS failed to destroy Congressman Hansen the “Public Integrity” section of the DOJ stepped in to finish the job. In 2009 James Cole, who was on the frontlines of the framing and railroading of George Hansen, was appointed Deputy Attorney General by President Barak Hussien Obama. During the IRS Tea Party hearings in 2014 Cole made several appearances before Congress. His message was the same: the DOJ was investigating the Tea Party matter of alleged IRS criminal behavior rendering him unable to comment. In October 2015 -long after the hearings ended – Cole announced that the DOJ gave the IRS a clean slate regarding IRS’ attack on the Tea Party.

James Cole is the DEEP STATE hood who helped choreograph the framing, conviction and railroading of Congressman George Hansen after the IRS failed to destroy him. The notion that Cole would properly investigate IRS’ crimes is laughable.

In his April 1983 letter to Deputy Attorney General D. Lowell Jensen, James McKenna pulled no punches:

“I am having a difficult time determining whether I am more offended by your persecution of my client or by the raw crudity of the rig job.”
